These terms cover purchases through a Rooted Commons weekly market. Contact your Circle’s contact about an order, return or complaint.

Who you buy from

Each product’s legal seller is identified before you confirm your order and in your order record. Your basket may contain separate purchases from different sellers.

For direct-to-member sales, the named seller sells to you and the Circle Operator acts as its disclosed agent to take orders, receive payment and arrange fulfilment. For goods the Circle Operator buys for resale, or sells on its own account, the Circle Operator is your seller.

Where Roots to Fruits CIC operates your Circle or sells goods itself, its details are: company number 14699477, 95 St. Michael’s Road, Aldershot, GU12 4JJ. Running the website does not make the Platform Operator the seller of every item.

Your Circle is the first contact for order problems and will coordinate with the relevant seller. You keep your rights against that seller.

Ordering and payment

Check the items, seller details, total and collection arrangements before submitting. Prices include any applicable VAT; delivery charges are shown before you commit.

A purchase is accepted when it is shown as Confirmed. Reserved means the items are held while payment is outstanding. If payment does not arrive by the stated deadline, the reservation may be cancelled and its charge reversed. We will tell you if it is confirmed or cancelled.

Orders normally use member credit. When received funds, including funded member credit, are applied to an accepted purchase by the seller or its authorised agent, you have paid that amount to the seller. You do not have to pay it again because the agent delays or fails to pass it on. An unfunded reservation or a bookkeeping entry alone is not payment.

Later price changes do not change an order already placed. We will not substitute a different item or increase its price without your agreement.

Product information and collection

Required product information is provided before purchase. Sellers keep their information accurate; each business remains responsible for its own supply, handling and safety duties.

Your order record gives the collection point, date and time. Contact us promptly if you cannot collect. We cannot promise extended storage of perishable goods. Goods remain at the seller’s risk until you or your nominated recipient takes physical possession; delivery to a collection point alone does not transfer that risk to you.

Changing or cancelling

You may change or cancel a weekly-market order while ordering remains open. Afterwards, preparation may prevent ordinary changes, but your legal rights remain.

For goods carrying the statutory change-of-mind right, tell us you are cancelling within 14 days after you receive them. You then have 14 days to return them. Email us for the appropriate return address. You pay the direct return cost unless the goods are faulty or we agree otherwise.

This change-of-mind right does not apply to goods liable to deteriorate or expire rapidly, or to sealed goods genuinely unsuitable for return for health or hygiene reasons once unsealed. It does not remove rights where goods are faulty or incorrectly described.

For a qualifying cancellation, we refund the goods and any standard delivery charge due within 14 days of receiving them back or evidence of return, whichever is earlier. Where no goods were supplied, we refund within 14 days of your cancellation notice. We may deduct for handling beyond what is necessary to establish their nature, characteristics and functioning, where the law allows.

Problems and refunds

Tell us if goods are missing, damaged, unsafe, spoiled or not as described. You have legal rights to goods of satisfactory quality, fit for purpose and matching their description. These may include rejection and a refund, replacement or a price reduction. Contacting us promptly helps resolve the issue; it does not impose a shorter legal claim period.

We normally restore member credit for a cancelled or refunded purchase paid that way. Where a monetary refund is due, we make it without fees using the original payment method unless you agree otherwise. Refunds for faulty goods include reasonable return costs. Follow recall instructions rather than returning unsafe goods without arrangement.

For a reported storage or handling failure at a collection point it appointed, the Circle Operator funds any refund or replacement due while it resolves responsibility with the seller or Host. You do not have to wait for that dispute to end. Your rights against the seller remain.

English and Welsh law applies without removing mandatory rights or access to courts available where you live.

Cancellation form

An email stating that you wish to cancel is sufficient. You may use this form where a cancellation right applies:
